1. Agreement to Terms

By accessing or using SaaSAnalytics ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

The Service is operated by a sole proprietorship registered in Hungary, and these Terms are governed by Hungarian law and EU regulations, including the General Data Protection Regulation (GDPR).

2. Description of Service

SaaSAnalytics is a privacy-focused web analytics platform that helps website owners understand their traffic and user behavior. The Service includes:

• Real-time website visitor tracking and analytics
• Page views, sessions, and bounce rate monitoring
• Traffic source and referrer analysis
• Geographic and device-based visitor insights
• Custom event and goal tracking
• User journey and funnel analysis
• Privacy-compliant, cookieless tracking option
• Dashboard with customizable date ranges and filters
• Multiple website support under one account

3. Account Registration

To use the Service, you must create an account by providing:

• A valid email address
• Your full name
• A secure password meeting our requirements (minimum 8 characters, including uppercase, lowercase, number, and special character)

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account
• Ensuring the accuracy of the information you provide
• Ensuring you have the right to add tracking to websites you register

4. Payment Terms

4.1 Subscription Model

SaaSAnalytics operates on a subscription-based pricing model. You may choose from monthly or annual billing cycles. Subscriptions automatically renew unless cancelled before the renewal date.

4.2 Free Trial

We offer a free trial period for new users to evaluate the Service. No credit card is required to start your trial. At the end of the trial period, you may subscribe to continue using the Service.

4.3 Payment Processing

Payments are processed securely through Stripe, a PCI-DSS compliant payment processor. We do not store your credit card information on our servers.

4.4 Billing Address

During checkout, you will be required to provide a valid billing address for invoice generation purposes.

4.5 Invoicing

Electronic invoices are generated in compliance with Hungarian tax regulations. Invoices are sent to your registered email address upon successful payment.

4.6 Currency

Prices are displayed in USD. The final charge will be processed in the currency selected during checkout.

4.7 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to the Service until the end of your current billing period.

5. Refund Policy

5.1 Satisfaction Guarantee

We offer a satisfaction guarantee. If you are not satisfied with the Service, you may request a refund within 14 days of your initial purchase or renewal date.

5.2 Refund Process

To request a refund:

• Include your account email and reason for the request
• Our team will review your request within 5 business days
• Refunds are processed through Stripe to your original payment method
• Refunds typically appear within 5-10 business days

5.3 Refund Eligibility

Refunds are subject to the following conditions:

• Request must be made within 14 days of payment
• Account must not have violated these Terms
• Prorated refunds may be offered at our discretion

6. User Conduct and Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Violate any applicable laws or regulations
• Use the Service to track websites you do not own or have permission to track
• Collect personally identifiable information without proper consent
• Attempt to gain unauthorized access to the Service or related systems
• Use the Service to harass, abuse, or harm others
• Engage in any activity that disrupts or interferes with the Service
• Use automated tools to extract data from the Service without permission
• Share your account credentials with others
• Resell or redistribute the Service without authorization
• Reverse engineer or attempt to extract the source code of the Service
• Use the tracking script on websites containing illegal content

7. Intellectual Property Rights

7.1 Service Ownership

The Service, including its design, features, functionality, code, graphics, and content, is owned by the operator and is protected by copyright, trademark, and other intellectual property laws.

7.2 Your Data

You retain all ownership rights to your analytics data. By using the Service, you grant us a limited, non-exclusive, royalty-free license to store, process, and display your analytics data solely for the purpose of providing the Service to you.

7.3 Tracking Script

We grant you a non-exclusive, revocable license to use our tracking script on websites you own or have permission to track, solely for the purpose of using the Service.

8. Data Storage and Retention

We store your analytics data securely. However:

• We are not responsible for data loss due to technical failures, security breaches, or force majeure events
• Analytics data may be retained for a reasonable period after account termination
• You may export your analytics data at any time through the dashboard
• Deleted websites and their associated data may be permanently removed after a retention period

9. Service Availability and Modifications

9.1 Availability

We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or technical issues.

9.2 Modifications

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.

9.3 Updates

We may update the Service with new features, improvements, or security patches. Your subscription includes all updates released during your subscription period.

10. Account Termination

10.1 Termination by You

You may terminate your account at any time by cancelling your subscription and contacting us. Termination does not entitle you to a refund unless you are within the refund eligibility period.

10.2 Termination by Us

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• Your account is used for fraudulent or illegal activities
• You track websites without proper authorization
• Required by law or court order

10.3 Effect of Termination

Upon termination:

• Your access to the Service will be revoked
• We may delete your analytics data after a reasonable retention period
• You should export any data you wish to retain before termination
• Provisions regarding intellectual property, liability, and dispute resolution will survive termination

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED
• WE DISCLAIM ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM
• WE ARE NOT RESPONSIBLE FOR DATA LOSS, SERVICE INTERRUPTIONS, OR THIRD-PARTY ACTIONS
• WE ARE NOT RESPONSIBLE FOR THE ACCURACY OF ANALYTICS DATA OR BUSINESS DECISIONS MADE BASED ON SUCH DATA

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such cases, our liability will be limited to the maximum extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless the Service operator, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations
• Websites you track using the Service and their compliance with applicable laws

13. Third-Party Services

The Service integrates with the following third-party services:

• Stripe: Payment processing (subject to Stripe's Terms of Service)
• Resend: Email delivery service
• MongoDB: Database services
• Upstash Redis: Rate limiting and caching

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the actions, policies, or practices of these third parties.

14. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

We comply with:

• EU General Data Protection Regulation (GDPR)
• Hungarian data protection laws
• Other applicable data protection regulations

15. Dispute Resolution and Governing Law

15.1 Governing Law

These Terms are governed by and construed in accordance with the laws of Hungary, without regard to its conflict of law provisions. EU regulations, including GDPR, also apply where relevant.

15.2 Jurisdiction

Any disputes arising out of or related to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Hungary.

15.3 Informal Resolution

Before initiating formal legal proceedings, we encourage you to contact us to seek an informal resolution of any dispute.

16. Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:
